The
12 winning organizations must
provide a facility and lunch for
all participants.
The
winning organizations must agree
to let Toobeez International
take pictures and/or video of
seminar.
It
is requested that management be
involved in the training.
Training
must be scheduled and completed
by December 31, 2007 and must be
completed in one day.
The
winning organizations must sign
a contract with Toobeez
International agreeing to the
above terms.
Deadline
for submission is April 30,
2007.
Winners
will be chosen May 6, 2007 and
notified by May 10, 2007.
INSURANCE: Toobeez does not provide accident or medical insurance for individual participants or groups.
LIABILITY: The Winners, their successors, and/or assigns hereby release, discharges, indemnifies and agrees to hold Toobeez harmless of and from any and all liabilities including liability for personal injury and/or property damage as well as any claims, demands, losses, costs, expenses, legal fees and damages arising out of or in any conjunction with this program regardless of the cause.
In the event that the Winner files a lawsuit against
Toobeez, the Winner agrees to do so solely in the state of
Pennsylvania, and the Winner further agrees that the substantive law of that state shall apply in that action without regard to the conflict of law rules of that state.
LIMITATIONS:
Toobeez is not responsible for any
incorrect and/or inaccurate
information, whether caused by site
users and/or by any of the equipment
and/or programming associated with,
and/or utilized in, the Giveaway or
by any technical or human error that
may occur in the processing of
submissions in the Toobeez websites.
Toobeez,
its respective affiliates, parents,
subsidiaries, or agents are not
responsible for lost, interrupted or
unavailable network service or other
connections; miscommunications,
failed telephone or computer
transmissions; injury or damage to
any computer related to or resulting
from participation or downloading
any materials in the Giveaway;
jumbled, scrambled or misdirected
transmissions; late, lost,
illegible, incomplete, stolen,
misdirected, illegitimate, or
impermissible entries; postage due
mail; or any other error whether
human, mechanical or electronic.
Each
entrant agrees that Toobeez and its
respective affiliates, agents,
employees, directors, and officers
are not liable whatsoever for
injury, damage, expense, accident,
delay, irregularities, loss or claim
caused or claimed to be caused,
directly or indirectly, by
participation in this Giveaway,
or by the acceptance, possession,
use or misuse of any prizes awarded.
By
participating in the Giveaway and
redeeming a prize, winner releases
Sponsor, and its respective
affiliates, agents, employees,
directors and officers, as well as
all prize suppliers, from any and
all loss, liability or damage
resulting from or arising out of
participation in this Giveaway.
Toobeez
reserves the right, at its sole
discretion, to suspend and/or cancel
the participation of any person or
to disqualify any individual it
finds to be tampering with the entry
process or the operation of the
Sweepstakes or site; to be acting in
violation of the Giveaway Rules; or
to be acting in a disruptive manner.
An
attempt by an entrant and/or
individual to deliberately damage
any Web site, and/or undermine the
legitimate operation of the
Giveaway, may be a violation of
criminal and civil laws. Should such
an attempt be made, Toobeez reserves
the right to seek damages from any
such individual to the fullest
extent permitted by law.
Toobeez
reserves the right to change these
Official Rules with respect to any
future drawings. Further, if, for
any reason, the Giveaway is not
capable of running as planned,
including infection by a computer
virus, bugs, tampering, unauthorized
intervention, fraud, technical
failures, and/or any other causes
either within or beyond the control
of Toobeez or which corrupt or
affect the administration, security,
fairness, and/or proper conduct of
this Giveaway, Toobeez reserves the
right at its sole discretion to
cancel, modify, and/or suspend the
Giveaway at any time.
